Important Update: Safe Harbor Eviction Protection Period Extended

Tenants must pay rent each month or risk eviction. The Governor recently signed SB 891, which extends temporary “Safe Harbor" protections protecting renters from nonpayment eviction until a tenant's rent assistance application is no longer pending. All safe harbor protectionsexpire on Sept. 30, 2022.

To be protected, tenants must give proof that they have applied to their landlord by June 30, 2022, or at or before any first court appearance, whichever is sooner. Documentation can be:

  • a copy or photo of the documentation by email or text message
  • a screenshot, or other written or electronic documentation verifying the submission of an application for emergency rental assistance

Once a tenant has given their landlord documentation of their application, the landlordmay notmove forward with a termination notice or an eviction action until the application has been closed, denied, or paid. If your application is closed, denied, or paid in an amount that is less than is owed, your landlord can move forward with the eviction process.

After June 30, only tenants who have submitted their safe harbor documentation will be protected while their applications are processed.

Landlords are required to give ten days of notice of termination of tenancy for nonpayment until Sept. 30, 2022. If you receive a 10-day notice for nonpayment:

If you haven't already, apply for emergency rent assistance and provide documentation to your landlord.

Who is eligible?

The OERAP programcan serve renter households that have incomes less than 80% of Area Median Income who meet the following conditions:

  • Individual(s) in the household has qualified for unemployment benefits or has experienced a reduction in household income, incurred significant costs, or has experienced other financial hardship due directly or indirectly to the coronavirus outbreak; and
  • Individual(s) in the household can demonstrate a risk of experiencing homelessness or housing instability evidenced by a past due rent notice.

This data is pulled by Oregon Housing and Community Services from the Allita system on a weekly basis in order to understand who has applied for Oregon's Emergency Rental Assistance Program. Please note that this data may contain manual user errors, including incorrect amounts requested for rent. Not all of the data in this dashboard has been verified by our partners who process applications, so these numbers will surely change as applications continue to be processed, verified, and paid.
